Trump Initial Executive Orders on Immigration

We will do our best to keep this list updated. Most of the orders do not directly affect our clients. For those that may, we will publish separate articles as they develop.


Because many of the executive orders are duplicative, this is not a complete list of all immigration-related executive orders.

Ends birthright citizenship, established by the 14th Amendment to the U.S. Constitution.

Temporarily blocked by federal court order

Militarizes the southern border and orders continued construction of the border wall.

Active

Increases border enforcement, including ending parole, more detention, swift removal, and reopening the "remain in Mexico" program. Calls for criminal prosecution of unlawful entrants and those who "facilitate their unlawful presence." Encourages partnerships with local authorities to enforce immigration law.

Active

Increases vetting for all visa applicants and applicants for immigration status in the United States. Lays the groundwork for invoking the Alien Enemies Act to justify expanding expedited removal to the interior of the country.

Revokes Biden executive orders, which identified enforcement priorities, allowed for the use of prosecutorial discretion, addressed asylum processing at the border, worked to reunify families separated at the border, and encouraged USCIS to adjudicate benefits applications fairly and efficiently.

Directs the Secretary of State to issue new guidance putting America First in all its operations.

Indefinitely pauses refugee admissions and decisions on refugee applications.

In effect, except for those with approved refugee status and travel booked before Jan. 20, 2025

Virtually shuts down asylum processing at the border

Found illegal by a federal court judge, likely to be appealed

Revokes August 2000 order, "Improving Access to Services for Persons With Limited English Proficiency"
